The terms and conditions, as laid out below, need to be accepted prior to any equipment being hired.
1. Definitions
a. The “Lessor” refers to ALLFRIENDS AV HIRE PTY LTD (ACN: 639 236 696)
b. The “Lessee” refers to the client receiving the “Equipment”. The Lessee can be an associate or representative of the lessee and may also be an entity.
c. “Equipment” refers to leads, stands, speakers, decks, lighting, covers, speaker bags, speaker stands, all intricate parts, all parts associated with the equipment selected and anything else which is invoiced.
d. “Booking” refers to all equipment that is leased to the Lessee by the Lessor in each transaction.
2. Security Deposit
a. The Lessee will provide a security deposit of $200 prior to each booking. This $200 will be returned back to the Lessee after the lessor has received the equipment back in the original and clean condition unless 2(b), 2(c), 2(d) or section 3 or 4 apply. The payment will be made via bank transfer. It may take up to 10-15 business days for deposit to be returned.
b. If there is any damage, missing items, scratches, dents, or the equipment was not returned back how it was given, the lessor reserves the right to the $200 security deposit.
c. As a condition of the booking, the lessee must disclose the location and nature of the event. In the circumstance that changes to the location and nature of event change, the lessee must advise the lessor of the changes. If the lessee is untruthful to the nature, location or changes of the event, the lessor reserves the right to the $200 security deposit.
d. For outdoor or exposed events – In the event of any or all of the following: forecasted rain, storms, heavy winds, hail, severe heat, or any other extreme weather conditions, the $200 security deposit may be supplemented by a $1,000 deposit per speaker, subwoofer, CDJ, mixer or other hired item. The customer agrees to this fee, which may be implemented at any point leading up to the event.
3. Damages
If the equipment is not returned in the same condition it was received in, by the lessee, it will be deemed the responsibility of the lessee to pay for any damages associated with the equipment. The lessor reserves the right to charge the lessee’s payment method from the original booking and claim back the damages in the following circumstances:
a. Any damage as a result of use, missing items, scratches or dents.
b. All damages, including any water damage, sun damage, sand/dust damage and any other damage caused by negligence.
c. Damages which cannot be repaired:
i. If damages cannot be repaired the lessor reserves the right to deduct the full cost of the equipment from the lessee.
d. Damages include dirty equipment. The lessee shall at his/her own expense clean and maintain the equipment for the period of hire.
4. Period of Hire
a. The period of hire refers to each 24-hour period or other period of hire as agreed to by the lessor and the lessee prior to the booking.
b. If the equipment is not returned back to the lessor by the agreed time a penalty will be charged at a rate of $50 per hour. The lessor reserves the right to charge the lessee’s payment method from the original booking in this circumstance.
5. Cancellations
Cancel 14 days or more before event date = full refund
Cancel 7-13 days before event = 30% cancellation fee
Cancel 1-6 days before the event = 50% cancellation fee
Cancel day of event = no refund
Partial cancellations will be charged pro rata at the above rates.
6. Additional Terms
a. The Lessee is liable and accepts full responsibility for any new damages, loss or misplacement of equipment for any reason whatsoever during the period of hire. This includes any water damage, sun damage, sand/dust damage and any other damage caused by negligence.
d. The Lessor shall not be liable to the personal injury or death of the Lessee and his successors, or other persons in any way, which are caused by, or relating to the equipment or its use. In addition, the Lessor shall not be liable to any damage to, or loss, or destruction of the lessee’s property in any way, which are caused by, or relating to the equipment or its use. The Lessee acknowledges that, due to the nature of sound equipment, the equipment may move or potentially become unstable at any stage and it is the responsibility of the lessee to insure the equipment is always stable and will not cause harm to property of any kind or persons. The lessor has no responsibility or liability.
c. The Lessee is not only responsible for the safety all equipment hired, but to ensure that equipment has been setup to as safely as possible. The Lessor will not be publicly liable for any damages, personal injury, and destruction of property to any persons or property affected.
“AVBOOKINGS” ABN: 86 690 865 854 will not be liable for any damages to property of any kind, or damages to persons of any kind. AVBOOKINGS is an affiliate and booking agent on behalf of ALLFRIENDS AV HIRE PTY LTD and hence only fulfils availability and booking of equipment.
